Significant Change to Modernised Award Transition Commencement -

Advised by Victorian Chamber Commerce and Industry (VECCI) 23rd July 2010

Please be advised that VECCI has identified that Fair Work Australia has made a significant change to the Social, Community, Home Care and Disability Services Industry Award 2010; relating to the transitional arrangements contained in Schedule A of the award.

Vice President  Watson handed down the decision effecting this change to the award’s transitional arrangements on 20 July 2010.

Previously, the transitional arrangements relating to penalties and loadings were applicable from 1 July 2010. The decision defers the commencement of the transitional arrangements to 1 July 2011.

Transitional arrangements are significant where there is a difference between the pre-modern (‘old’) award and Modern Award as they determine the commencement date and arrangements for phasing in and out of certain award terms. In this instance, these terms include:

  • casual or part-time loading;
  • Saturday, Sunday, public holiday, evening or other penalty;
  • shift allowance/penalty (please note that this does not include overtime)

As a consequence of Fair Work Australia’s decision, the phasing in or out of any applicable penalties or loadings (both higher and lower) is now effective from 1 July 2011.

Until this time, employers covered by the modern award will continue to derive penalties, casual-part time loadings, shift allowances and penalties from the applicable pre-modern award.  This means that employers should continue paying all applicable penalties and loadings  from their ‘old’ award (e.g. SACS Award, Disability Services Award, Residential and Support Services Award etc) until 1 July 2011.

VECCI will update its award and wage summaries to reflect these changes shortly. Further correspondence in relation to this will follow.
